Same sex parents have standing to adopt their children in Illinois pursuant to the Adoption Act as held by the Illinois Appellate Court, First District. (The First District is located in Chicago, Cook County, Illinois.) The Adoption Court in Cook County handles many co-parent adoptions, which are also called “same sex adoptions” or “second parent adoptions”. These cases often arise when one of the adoptive parents is a biological parent. In some cases one person in the couple has adopted a child internationally and both persons in the couple then adopt in this country.
